Referral Program

The 4everfans Referral Program is operated by 4everfans LLC.
In these Referral Program Terms, the words "platform" refers to the 4everfans website, "we", "us", "our" and "4everfans" refers to 4everfans, "you" "user" and/or "Referring user" refers to you, the user who registers for the 4everfans Referral program and "Referring Creator" means the person who joins 4everfans as a Creator through the Referring User's unique referral link.
These Referral Program Terms are additional terms that apply if you use the 4everfans Referral Program. These Referral Program Terms form part of our Terms and Conditions and any legal notices published by 4everfans and should be read in conjunction with them.
1. 4everfans Referral Program: Existing users can recommend new users to 4everfans who are interested in becoming Creators in exchange for referral payments from 4everfans, which are calculated and capped in accordance with the Referral Program Terms.
2. 4everfans Referral Program Rules: Users must abide by the following guidelines in order to participate in our Referral Program:
This means that the Referring User's referral payments for that Referring Creator will be capped at US$50,000 overall if the Referring Creator generates Fan Payments with a total value of US$1 million or more in the twelve months following the date on which that Referring Creator registers as a 4everfans User. However, in the twelve months following the date on which the Referring Creator registers as a 4everfans User, if the Referring Creator generates Fan Payments with a total value of less than US$1 million, then five percent (5%) of the Fan Payments generated by the Referring Creator in the twelve months following the date on which the Referring Creator registers as a 4everfans User, then five percent (5%) of the Fan Payments generated by the Referring Creator in the twelve months following the date.
Referral payments will be made to the relevant Referring Users for all referrals made before May 1, 2020 up until May 1, 2021, or until $50,000 USD has been given to the Referring User for the referral, whichever comes first. If you are a Referring User, you should be aware that any VAT that is or becomes due on any supplies you make will be included in all reference payments that we make to you.
5. Selecting a Payment Method: You must first select one of the payment options offered by 4everfans in your country in order to receive payments for referrals. "Payment Options" are the name for these processes.
6. Frequency of Referral Payments. Around the first day of the following month, you will receive the reference payment you are entitled to for any Fan Payments made to the referring creator during that month. (which means, for example, that the referral payments due to you for Fan Payments made to the Referring Creator in June will be paid to you around July 1).
7. Warning: Please read the following warning regarding the 4everfans Referral Program in accordance with regulation 3 of the Trading Schemes Regulations 1997 (as modified) and section 120(1) of the Fair Trading Act 1973.
It is against the law for us or a member of the 4everfans Referral Program (including Referring Users and Referring Creators) to induce anyone to pay money by promising rewards for enticing others to sign up for the program. Don't believe promises that the 4everfans Referral Program makes it simple to earn large sums of money.
8. Rights of 4everfans in Relation to the Referral Program: If referral payments have been made incorrectly, we have the right to claim the money back from the user who received it.
In order to validate any reference payments to be made and the recipient of any referral payments, we may require you or the Referring Creators to provide us with your identification and any other information we deem reasonably necessary. You risk losing your eligibility to receive reference payments with regard to the relevant Referring Creator if you don't give us the requested information.
No change will deprive any Referring User of referral payments already earned based on Fan Payments made to Referring Creators prior to the changes taking effect. We reserve the right to change any aspect of the 4everfans Referral Program (including how referral payments are calculated) or discontinue the program at any time.
9. Withholding of Referral Payments: we may withhold referral payments in the following circumstances:
Any referral earnings owed to you but not yet received may be withheld entirely or in part by us.
If we think you have repeatedly or seriously violated any of our terms and conditions, or that you may have violated any of them.
If you attempt to violate any of our Terms and Conditions or make threats to do so in a manner that could have serious repercussions for us or another user, including actual or potential loss to us or another user.
If, during the course of our investigation into the actual, impending, or suspected violation(s) by you or the suspected illegal or fraudulent activity, we have reason to believe that all or a portion of the referral payments due to you are the result of illegal or fraudulent activity, whether on your part, that of the Fan who made the Fan Payment to the Referring Creator that resulted in the referral payment, or on the part of the Referring Creator to whom the Fan Payment was made that resulted in the referral payment, (as applicable). If, following our investigation, we determine that you have seriously or repeatedly violated any of our Terms and Conditions, that you have attempted to or have threatened to violate any of our Terms and Conditions in a way that has or could have serious repercussions for us or another User (including actual or potential loss caused to us or another User), and/or that all or a portion of the referral payments owed to you are the result of illegal or fraudulent activity, we may notify you of this.
If we learn that you have secured, pledged, assigned, or otherwise allowed a lien to be put on the referral payments for recommendation, we may also withhold all or a portion of the referenced payments that are owed to you but have not yet been paid. We do not owe any third parties any recommendation fees, and we reserve the right to defer payment of the Creator's earnings until the lien has been released.
When we are permitted to do so by these Referral Program Terms, we may withhold or forfeit any money owed to you under the 4everfans Referral Program without incurring any liability to you.
If we are withholding all or a portion of the referral payments that are owed to you and we determine that a portion of those payments is not related to your violation of our terms and conditions or any suspected illegal or fraudulent activity, we may make arrangements for you to receive the referral payments that are not related to those violations. However, you acknowledge that we may withhold all referral payments owed to you that have not yet been made and deduct those sums from any losses we have incurred if we believe that your violation of our terms and conditions has caused or is likely to cause us loss.

- A single 4everfans A active user account is required to take part in the 4everfans Referral Program. Users are not permitted to take part in the 4everfans Referral Program if their accounts have been suspended or canceled by us for any reason or deleted by them.
- In order to receive payments through the 4everfans Referral Program, you must submit the information for your bank account or a payment method to your Referring User account.
- Each user has a special referral link that they can share with others (and which they can reach through the account of the Referring User). You must not impersonate 4everfans or give the idea that your referral link is being shared or promoted by us when sharing your special referral link. You may not share or advertise your specific referral link using any search engine advertising tool. In the Referring User account settings, the referred user must be transparent about the procedures or channels through which they distribute their special referral code.
- The Referring Creator must use the same browser they used to click on your special referral link in order to join with 4everfans. We won't link a new user's account to your referral if they sign up for 4everfans using a different method than your special referral code, and you won't receive any referral compensation.
- Prior to clicking on your unique referral link, the Referring Creator must not have created a user account with 4everfans (either under the same name or a different name). No payment will be given to you for the referral if the Referring Creator is or has ever been a 4everfans user.
- You will only receive referral payments if the Referring Creator establishes one user account; if the Referring Creator creates additional user accounts, no referral payments will be made to you. You won't receive any reference bonuses for any additional user accounts the Referring Creator creates.
- The referral of a Referring Creator that we determine you own or run or with whom you have a business connection will not result in payment to you. You agree to give us any information we ask for in order to establish whether you own or run the Referring Creator or whether you have a business connection with it.
- You won't misrepresent 4everfans, the products, services, or material made available through it, its users, or our terms and conditions.
- You will not imply to a prospective Creator that using 4everfans will result in the Creator earning a specific amount of money or any amount of money, nor will you make any claims about the likely number of Fans.
This means that the Referring User's referral payments for that Referring Creator will be capped at US$50,000 overall if the Referring Creator generates Fan Payments with a total value of US$1 million or more in the twelve months following the date on which that Referring Creator registers as a 4everfans User.
